Furlough agreements and grants – navigating the key risk areas of the Job Retention Scheme

As a business owner you may well have already taken advantage of the Job Retention Scheme.  You have made the decision on who to furlough, signed appropriate agreements and are now awaiting the grant application form. Or you may still be planning the “hibernation” of your business or trying, as an adviser unversed in the detail of employment law, to help a business owner.

Either way, now perhaps is the time to take stock and review what may be hidden pitfalls and complexities or grey areas.

Suppose you are a sole director or a husband and wife team who take minimum salaries (or are they actually something slightly different, director’s fees) plus dividends.  Can you structure things so you or one of you goes on furlough but how does that work if you are the only or one of just two directors?  How can you lawfully apply for the grant but avoid the hibernation being terminal for your business as you cannot keep it ticking over?

What about accrued holiday entitlement during furlough?  Could you ask your team to take some holiday whilst on furlough and what about allowing holiday carry forward to next year?
